David Tishbi, Inc. v. Gabriel Ofiesh, Civil Action No. SACV 08-00501 (US District Court, Central District of California; Filed May 6, 2008; Judge Andrew J. Guilford) Represented Plaintiff as lead counsel in a declaratory judgment action seeking declaration of non-infringement, unenforceability, and invalidity of US Patent No. D424,966, 6,295,732, and 6,497,117. The case involved patent infringement of jewelry designs. Our client filed a complaint for declaratory judgment on non-infringement and invalidity after defendant sent our client a cease and desist letter. Read our complaint. Allstar Tire and Wheels v. Wheel Pros, Inc., Civil Action No. SACV08-00563 AHS (US District Court, Central District of California; Filed 2008; Judge Alicemarie H. Stotler) Represented Plaintiff Allstar Tire and Wheels as lead counsel in this design patent infringement litigation concerning design of lip covers for aftermarket wheels. The court granted Wheel Pros motion for summary judgment on invalidity, which we appealed. Read our complaint for patent infringement. Savini Styling Group, Civil Action No. 2-07-CV-448 (TJW) (US District Court, Eastern District of Texas; Filed October 9, 2007; Judge Rodney Gilstrap) Represented Plaintiff Allstar as lead counsel in this design patent infringement litigation concerning design of lip covers for aftermarket wheels. Kato v. Allstar Tire and Wheel, 2:06-cv-05051-PA-RZ (US District Court, Central District of California; Filed August 14, 2006; Judge Percy Anderson) Represented Defendant Allstar in this design patent infringement lawsuit regarding aftermarket vehicle wheel design. Microsoft Corporation v. PC Menu, Inc., Case No. 04-71-A (US District Court, Eastern District of Virginia; Filed 2004; Magistrate Judge Theresa Carroll Buchanan) Microsoft sought to enjoin Defendants from infringing Microsoft’s copyrights and trademarks in defendants’ sale of software. Microsoft also sought damages for Defendant’s alleged marketing, advertising, distribution and/or offering for distribution of counterfeit and infringing Microsoft’s software programs and/or components. Attorney David Jafari was an associate on the legal team that represented defendants. Opposing counsel: Piper Rudnick LLP, John J. Dwyer.

Hewlett-Packard Company v. Intergraph Corporation, Civil Action No. 3:03-cv-02517-MJJ (US District Court, Northern District of California; Filed 2003);

Hewlett-Packard v. Intergraph Hardware Technologies Co, Intergraph Corp. v. Dell Computer Corp., Civil Action No. 2:02CV 312 (US District Court, Eastern District of Texas; Filed 2002). Represented Intergraph Corporation as part of core team of attorneys in patent infringement lawsuits involving multi-processor computer systems with cache memory coherency and updating technology.

Certain Data Storage Systems, ITC Inv. No. 337 TA 471 (2003), Represented Respondent Hitachi Ltd as part of a core team of attorneys against Complainant EMC in this section 337 investigation involving computer data storage systems for the sharing, management and protection of large amounts of data and information. The asserted EMC patents were directed to Remote Data Mirroring, Data Migration, Disk Mapping and Data Retrieval for automatically providing and maintaining data at a remote site. The EMC products that practiced the inventions included EMC Symmetricx Data Storage.

Scimed Life Systems, Inc. And Corvita Corp. v. Medtronic AVE, Inc. and Medtronic, Inc., Case No. 02-131 (US District Court, District of Delaware; Filed 2002) Represented Defendant Medtronic as part of a core team of attorneys against Scimed in this patent infringement litigation lawsuit involving Medtronic’s AAA AneuRx Stent Graft System.

Medtronic Vascular, Inc. v. Boston Scientific Corporation, et al., Case No. 98-478-SLR (US District Court, District of Delaware; Filed 1998; Judge Sue L. Robinson) Plaintiff Medtronic Vascular, Inc. sued Boston Scientific Corporation and other defendants for patent infringement of Plaintiff’s balloon expandable stents that were used in treating aneurisms. Attorney David Jafari was an associate on the McDermoth, Will, & Emory, LLP prosecution team that represented Plaintiff Medtronic Vascular, Inc. Opposing counsel: Kenyon & Kenyon, Douglas E. Ringel.

SanDisk Corporation, Represented Sandisk as part of a core team of attorneys to investigate patent infringement of SanDisk’s U.S. Patent No. 6,149,316 related to semiconductor electronically erasable programmable read only memories (Flash EEPROM Chips) Memory Systems.

Voltstar v. Newslink of Miami, LLC, and Kanex, Inc., Case No. 9:16-cv-80063 (US District Court, Southern District of Florida, and transferred to Central District of California; Filed January 13, 2016; Judge Manuel Real). Represented Defendant Kanex in this patent infringement lawsuit involving cellular phone charger plugs. Our firm obtained a settlement that did not require our client to pay any licensing fees, and furthermore, allowed our client to continue manufacturing and distributing the allegedly infringing product. Barco Inc. and Barco N.V. v. KanexPro, Inc. Represented Defendant in this patent infringement lawsuit filed in the Netherlands regarding Defendant’s MyTurn Wireless Presentation System. Our firm obtained a settlement whereby the lawsuit against Defendant was dropped.

Design Patent Appeal

Allstar Tire and Wheel, Inc. v. Wheel Pros, Inc., Appeal to United States Court of Appeals for the Federal Circuit (2011-1015) argued for the plaintiff-appellant in design patent infringement lawsuit regarding aftermarket auto wheel design. Trademark & Copyright Infringement

Apogee, Inc. v. Warner Bros. Entertainment, Inc. et al., Case No. 1:13-cv-01909 (US District Court, District of Columbia, Filed December 2, 2013; Judge Emmet G. Sullivan) Action for declaratory relief based on Digital Millennium Copyright Act involving devices used with HDMI products, such as a projector. Read plaintiff's First Amended Complaint. Lexani International, Inc. v. Mizban, et al., Case No. RIC10021142 (Superior Court of California, County of Riverside, Filed 2010; Judge Mac R. Fisher) Represented Defendant in this misappropriation of trade secrets, and unfair competition lawsuit. The case arose out of the manufacture and sale of after-market automobile grilles and accessories. Case was dismissed. Read plaintiff's complaint for unfair competition. Opposing counsel: Eric B. RBP Performance, Inc. v. Mizban, Case No. 2:10-cv-07872 (US District Court, Central District of California, Filed 2010; Judge Gary A. Feess). Represented Defendant in this copyright Infringement, trademark infringement, and trade dress infringement lawsuit. The case arose out of the manufacture and sale of after-market automobile grilles and accessories. Case was dismissed. Read plaintiff's complaint for copyright and trademark infringement. Universal City Studios Productions LLLP et al. v. Sswarez.com et al., Case No. 2:08-cv-08300 (US District Court, Central District of California; Filed December 17, 2008; Gary A. Feess) Represented one of defendants in this copyright infringement lawsuit related to infringement of copyrights in numerous motion pictures and other audiovisual works. Defendant was accused of promoting a for-profit website to allow members of the public to easily locate and download infringing copies of movies and films. Hearst Holdings, Inc. et al. v. Roger Lalwani et al., Case No. 2:08-cv-06932-FMC-JC (US District Court, Central District of California; Filed October 21, 2008; Judge Florence-Marie Cooper) Represented one of several defendants in copyright and trademark infringement action based on sale of “Betty Boop” embroiled merchandise. Guru Denim, Inc. v. Rath, Case No. 5:08-cv-00928 (US District Court, Central District of California; Filed July 11, 2008; Judge Virginia A. Phillips) Represented Defendant in this trademark infringement and copyright infringement lawsuit, false designation of origin and trademark dilution case. The case involved denim and non-denim men’s and women’s apparel under the True Religion Brand jeans pants line of apparel including the overall stitching pattern on the front of True Religion jeans. J & J Sports Production vs. Juan Arriaga Bueno et al, Case No. 5:08-cv-00936-WDK-FMO (US District Court, Central District of California; Filed July 14, 2008; Judge William D. Keller) Represented Defendant in this alleged unauthorized publication or broadcast of Bernard Hopkins v. Jermain Taylor Championship Fight Program in violation of Title 47 U.S.C. Medicine Online, Inc. v. BidRx, LLC, Case No. 8:06-cv-00873 (US District Court, Central District of California; Filed September 18, 2006: Judge David O. Carter) Represented Plaintiff after substituting in a lead counsel in this trademark infringement lawsuit regarding the mark BidRx related to providing an internet-based reverse auction bidding service for prescription drugs and medicine. M. Jafari and his firm took over the prosecution of this lawsuit after the complaint was drafted and filed by another firm. Mr. Jafari and his law firm prepared and filed the answer, and counterclaims, initiated discovery and subsequently settled the case for the plaintiff. R-1 Racing Sports, Inc. v. Meehan et al., SACV05-683 AHS (US District Court, Central District of California; Filed 2005; Judge Alicemarie H. BMW of North America, LLC, and Bayerische Motoren Werke AG v. Gogo Lighting Inc., and Zuying Shi, Case No. 8:16-cv-1176 (US District Court; Central District of California; Filed June 24, 2016; Judge David O. Carter). Represented Defendants in this trademark infringement lawsuit involving BMW’s trademarks and logos.

Phoenix Entertainment Partners, LLC v. KST Street, Inc., and Deanna Savage, Case No.8:16-cv-02006 (US District Court; Central District of California; Filed November 04, 2016; Judge James V. Selna). Represented Defendant KST Street in this trademark lawsuit involving Phoenix’s “Sound Choice & Design” mark. Our firm was able to negotiate a settlement agreement dismissing the case against Defendant.

Honey & Butter, LLC v. Christine Park, Opposition Proceeding No. 91238008 (United States Patent and Trademark Office; Filed November 27, 2017). Representing Plaintiff in the US Patent and Trademark Office in opposing Defendant’s trademark registration for the mark “Honey and Butter.”

Shavina Luckett vs. Kohl’s Department Stores, Inc., a Delaware Corporation, Case MCC1800997 (Superior Court of California; County of Riverside; Southwest Justice Center; filed September 5, 2018; Judge Jesus G. Bernal). Represented Plaintiff in wage and hour violation, race discrimination, failure to prevent discrimination, unlawful business practices (Cal. Business and Professions Code Section 17200 et seq.); and civil penalties pursuant to the California Private Attorneys General Act (Cal. Lab. Code Section 2698 et seq).  Plaintiff alleged she was subjected to racial discrimination, which include being permanently placed at the back of the store, while other cashiers were rotated on a regular basis (Plaintiff was the only black cashier in the store).  Defendants’ rotation policy was discriminatory against Plaintiff as a woman of color.  Plaintiff was also denied reasonable accommodation during her pregnancy, even though it was ordered by her physician. Garey v. Conway, Case No. 14K13340 (Superior Court of California; County of Los Angeles, 111 North Hill Street; Filed October 8, 2014) Represented Plaintiff, a consumer, in this collection case. Plaintiff alleged causes of action for fraudulent misrepresentation, rescission, violation of California Consumer Legal Remedies Act, and unfair competition. Martellato USA v. Nipa, Inc. v. Tavakoli et al., Case No. 30-2013-00672091 (Superior Court of California; County of Orange; Filed 2013; Judge Gregory Lewis Represented Defendant) Action by general contractor for breach of contract and recovery of labor and material rendered. Plaintiff also recorded a notice of lis pendens against our client's property. Read our motion to require plaintiff to provide an undertaking as a condition to maintaining the lis pendens. Composite Industire S.A. v. Vision Air America, Inc., Case No. 2:13-cv-01984 (US District Court, District of Arizona; Filed September 30, 2013; Judge James A. Teilborg Represented Plaintiff) Action for recovery of services rendered for repairing airplane parts. Pharma-Tech Services, Inc. v. Plan B Solutions, Inc., Case 30-2013-00661698 (Superior Court of California; County of Orange; Filed 2013 ; Judge Gregory Munoz Represented Plaintiff) Action for declaratory relief for invalidty of a non-compete clause in employment contract in violation of California Business and Professions Code § 16600. Parks Diversified, L.P. v. Jason Abbott et al., Case No. 30-2013-00661972 (Superior Court of California, County of Orange; Filed 2013 Represented Plaintiff) Action against residential tenant for unpaid rent. Defendant filed a cross complaint for breach of implied warranty of habitability and other claims based on alleged improper levels of arsenic in the well water serving defendant’s residence. Opposing counsel: James Rose.

United States v. Extradition Transport of America, LLC, Case No. 3:12-CV-46 (US District Court, District of North Dakota; Filed 2012; Judge Karin K. Klein) Represented Defendant insured, an interstate prisoner transport company, in a liaison capacity between insured and insurer’s panel counsel. The case involved monetary claims and penalties against defendant arising from costs incurred in recapture of Joseph Megna, a prisoner who escaped in North Dakota during a transport by defendant.
